1. Acceptance and Scope
By accessing this website or using our services, you agree to be bound by these terms. These terms apply to all users, including those purchasing individual masters or monthly subscriptions.
2. Audio Services
- Service Definition: We provide audio recording, mixing, mastering and transfer services. The goal is to ensure tracks are, especially mastered tracks are genre-appropriate and meet standard loudness requirements for streaming and distribution.
- Fair Usage (Subscriptions): “Unlimited” mastering plans are subject to reasonable use. Typical activity for individual creators—such as a few tracks per month—is expected; excessive use may be reviewed for compliance.
- File Requirements: Customers are responsible for providing high-quality, unclipped source files. Damaged or late files may delay completion.
3. Intellectual Property and Rights
- Customer Ownership: You warrant that you own or have the lawful right to use the audio material you provide. You retain all right, title, and interest in your original audio recordings.
- Work for Hire: The service we provide is generally considered a “work made for hire,” meaning you own the final recording and or mastered version immediately upon its creation.
- Unauthorized Content: You may not upload material containing unauthorized digital replicas of a person’s voice, which is prohibited under California’s Post-Mortem Right of Publicity law.
- Service Property: All proprietary algorithms, software, and website content remain the sole property of the service provider.
4. Payments, Subscriptions, and Refunds
- Payment Terms: Payment is typically due upon booking.
- Subscriptions: Subscriptions run for a minimum of one month and renew automatically unless canceled. Quota from one month does not carry over to the next.
- Refund Policy: No refunds or credits are generally provided for partial subscription months or if you fail to cancel before renewal. Cancellations of specific bookings may incur a fee, such as 50%.
5. Revisions and Final Delivery
- Revision Policy: We may offer a limited number of “reasonable” revisions before final delivery. Revisions requested after final delivery may be billed as a new job.
- Quality Guarantee: If the service fails to meet agreed-upon technical specifications, we may offer to repair or replace the work at no extra charge.
6. Limitation of Liability and Indemnification
- Disclaimer: The service is provided “as is.” We are not liable for any damages caused by technical interruptions or downtime.
- Indemnity: You agree to indemnify and hold us harmless from any third-party claims arising from your breach of these terms or copyright infringement in your uploaded audio.
- Liability Cap: Our total liability to you will not exceed the value of the fees you have paid for the specific service in question.
7. California Data Privacy (CCPA/CPRA)
If you are a California resident, you have specific rights regarding your personal information, including the Right to Know, Right to Delete, and Right to Opt-Out of the sale of your data. We do not sell your audio data and only use it to provide the requested services.
